Litigation Case Highlights

•  Obtained a substantial jury verdict for our investor clients against Texas E&P company and its owner for statutory real estate and securities fraud. The case was later settled favorably for our clients on appeal.
•  Obtained a significant jury verdict for our client for breach of contract and for misrepresenting the financial integrity of a real estate services business former owners sold to our client.
•  After a week long jury trial, settled for less than nuisance value, a case where Plaintiffs were seeking more than $15 million dollars based on allegations of securities fraud from our defendant clients.
•  Persuaded the Texas Supreme Court to affirm the decision of the Fifth District Court of Appeals in allowing our client to pursue her defamation case against a Texas magazine’s publisher.
•  Obtained defense victory after the United Stated District Court for the Southern District of New York granted partial summary judgment that precluded Plaintiff from recovering the millions in damages and fees it sought in connection with the acquisition of an insurance company.
•  After trial on the merits, obtained judgment in Texas state court on behalf of a trust beneficiary that a living trust created from a store-bought kit was not revoked by a subsequent professionally prepared last will and testament. As a result, the beneficiary of the living trust, not the beneficiaries under the will, was the sole owner of all of the deceased property, including substantial real estate holdings.
•  After trial on the merits, obtained Judgment for client who held several “top lease” rights for certain oil and gas leases held by a debtor in the United States Bankruptcy Court for the Eastern District of Texas that the debtor’s oil and gas leases had terminated due to lack of production and were not property of the bankruptcy estate, but belonged to our client.  Judgment was affirmed on appeal.
•  Assisted in securing the return of a painting to a family from the National Gallery of Art in Washington D.C. that later sold for over $28 million at auction. This appears to be the first time the National Gallery of Art deaccessioned a non-Holocaust painting from its collection.
•  Obtained a number of temporary injunctions and temporary restraining orders for business clients against former employees who violated their employment contracts.
•  Recovered substantial funds for Post-Confirmation Liquidating Trustee in the prosecution of numerous actions to recover preferential and fraudulent transfers made by debtors.
